The US Securities and Exchange Commission on October 1 proposed a framework for how registered investment advisers and regulated funds can hold crypto assets for their clients.

The proposal would update custody rules under the Investment Advisers Act and the Investment Company Act of 1940. It would remove barriers to advisers giving crypto-related advice, let regulated funds offer strategies tied to crypto, allow self-custody in certain cases and let state trust companies act as custodians.

SEC Chairman Paul Atkins said crypto has grown into a multi-trillion-dollar asset class while the rules have not kept up, and that the proposal would give advisers and funds a clear, compliant route to custody. The public can comment for 60 days after the release is published in the Federal Register.
